In accordance with the decree of the President of the Republic of Uzbekistan dated 11.04.2018 no. PD-5409 "On measures to further reduce and simplify licensing and licensing procedures in the field of business, as well as to improve business conditions” and the Decree of the President of the Republic of Uzbekistan dated 11.04.2018 no. PO-3662 "On additional measures to accelerate the development of the system of public services" from June 1, 2018:

  • Licensing of tourism (tour operator) activities has been transferred to regional departments of the State Committee for tourism development of the Republic of Uzbekistan and departments for tourism development;
    • The submission of documents for obtaining a license for the right to carry out tourist (tour operator) activities is carried out through the Centers of public services or through the Unified portal of interactive public services.
  • In this regard, to obtain a license for the right to carry out tourist (tour operator) activities, you can contact the regional Department of the State Committee for tourism development.

Decree of the Cabinet of Ministers of the Republic of Uzbekistan dated April 6, 2017 "On approval of the regulation of the procedure for licensing of tourism activities" annex 1 to the Decree No. 189 on the procedure for licensing of tourism activities. This regulation determines the procedure for licensing of tourism activities in accordance with the laws of the Republic of Uzbekistan "On licensing of certain types of activities", "On tourism", the decree of the president of the Republic of Uzbekistan "On measures to ensure the rapid development of the tourism sector of the Republic of Uzbekistan" dated December 2, 2016 PO-4861 and in accordance with the decree of the president of the Republic of Uzbekistan № PD–2666 on December 2, 2016 "On organization of activities of the state committee for the development of Tourism of the Republic of Uzbekistan", establishes the procedure for licensing of tourism activities.

The license applicant may be a legal entity registered in the Republic of Uzbekistan in accordance with the established procedure, which has applied to the licensing authority for the issuance of a license for the right to carry out tourist activities.

Licenses for the right to carry out tourist activities are issued to license applicants who provide services for organizing tourist travel, including booking, accommodation, transportation, catering, as well as recreational, excursion and other services in accordance with the terms of the contract for the provision of tourist services.

At the same time, for individual entrepreneurs who provide excursion services, obtaining a license for the right to carry out tourist activities is not required.

The licensing authority issues licenses in three areas:

Domestic tourism - the right to carry out tourist activities on the territory of the Republic of Uzbekistan to provide tourist services to individuals permanently residing in the Republic of Uzbekistan;

Outbound tourism - the right to carry out tourist activities outside the Republic of Uzbekistan to provide tourist services to individuals permanently residing in the Republic of Uzbekistan;

Inbound tourism - the right to carry out tourist activities on the territory of the Republic of Uzbekistan to provide tourist services to individuals living outside the Republic of Uzbekistan.

The right to carry out tourism activities is given standard (simple) licenses.

The license for the right to carry out tourist activities is issued without limitation of validity.

Terms and conditions of the license

The following are the requirements and conditions of the license in the implementation of tourism activities:

a) mandatory compliance with the legislation on tourism, international standards in the field of Tourism and standards of the Republic of Uzbekistan;

b) in the state of a legal entity there must be at least one specialist with a diploma of higher education or secondary special, vocational education in the direction of "tourism" or a valid certificate of qualification issued by the licensing authority for a period of 3 years in accordance with the established procedure;

C) employees of a legal entity (guides (leaders of the excursion)) to receive a certificate of qualification at least once in 3 years in the manner prescribed by the licensing authority;

D) according to the direction for the implementation of tourism activities:

"domestic tourism — - is equal to the amount established by law for the corresponding organizational and legal form of a legal entity;

"inbound and outbound tourism — - the amount of the base calculation to have a charter fund formed at least 400 times;

e) availability of a system for ensuring safety for the life, health and property of tourists and excursionists approved by the certificate of conformity of tourism services;

f) providing tourism services with the client only after the conclusion of the contract in accordance with the requirements of the legislation of the Republic of Uzbekistan, including in electronic form (online);

j) to convey to each tourist in the established order full information on the features of departure, arrival and stay in a foreign country, the characteristics of the behavior during tourist travel, as well as other rules of stay in each particular country;

h) to provide the client with full and detailed information about the working regime of the licensee, its location (postal address), the availability of the relevant license, the certificate of tourism services, the surname, name, patronymic of the specialists of the licensee responsible for specific areas of tourism activity, including the placement of this information on its official website on the international Internet network.

i) to have a multilingual website providing services such as electronic payments, booking, acquiring of licensee every year when serving more than 500 tourists.

 

Documents required for obtaining a license

For obtaining a license, the applicant submits the following documents to the licensing authority:

a) the name and organizational and legal form of the applicant for the license, the certificate of compliance in force for the provision of tourism services in the certificate of state registration as a business entity and the availability of information in the documents giving the right to the building for the implementation of tourism activities, the location of the applicant for the;

b) copies of documents in accordance with subparagraphs "b", "d" and "e" of Paragraph 8 of this regulation;

c) a copy of the payment document confirming the payment of the fee by the licensee for consideration of the application by the licensor;

d) information of the director with the indication of full name, date of birth, information on the passport, home address, degree, contact phone numbers.

The licensing authority receives the necessary documents and information available in other authorized offices for the issuance of a license independently in accordance with the established procedure by mutual information cooperation, including in electronic form.

It is not allowed to demand from the license applicant for the submission of documents not provided for in this regulation.

The necessary documents for obtaining a license are submitted by the applicant to the licensing authority directly, by mail or electronic means of communication with a notification of receipt.

The documents submitted in electronic form are certified by the electronic digital signature of the license applicant.

Documents, sent to the licensing authority for obtaining a license are accepted by the Responsible personnel of the licensing authority on the list, a copy of the list is sent to the applicant (submitted) with a mark on the date of receipt of the documents.

The license applicant is responsible for submitting false or distorted documents and information in accordance with the law.

For consideration of the application, the licensee pays a fee to the account of the licensing authority in the amount of 2.5 times the amount of the base calculation established on the day of payment.

The payment of the fee will not be refunded if the license applicant refuses the application.

The decision to issue a license or to refuse a license shall be taken on the basis of the expert opinion approved by the head of the licensing authority, within no more than ten working days from the date of receipt of the application of the license applicant with all the necessary documents specified in paragraph 9 of this regulation.

The licensing authority will inform the applicant of the decision taken within one day after the adoption of the relevant decision.

The notification of the decision to issue a license is sent to the applicant in written form, including through the information system, in electronic form, with the indication of bank account details, the period of payment of the state fee. Simultaneously with the notification of the decision to issue a license, a license agreement is sent to the applicant for signature of the license.

The licensing agreement, which establishes the mutual rights and obligations of the licensing authority and the licensee, is concluded between the licensing authority and the licensee, in which it is necessary to:

surname, name, patronymic, position of persons signing the agreement;

details of the parties;

the direction of tourism activities licensed for implementation;

terms and conditions of the license for licensee;

liability of the parties for violation of the terms and conditions of the license agreement;

the procedure for controlling the execution of the requirements and conditions of the license agreement by the licensee by the licensing authority.

The license agreement is concluded in two copies — one for the licensee and one for the licensor.

For the accounting, storage and purposeful use of license plates, the head of the licensing authority will personally respond.

The license is issued within two working days after the submission of a document indicating the confirmation of the payment of the state fee by the applicant and the signing of the license agreement.

When checking compliance with the requirements and conditions of the license, an act is drawn up in two copies by the personnel of the licensing authority, one of which is issued to the licensee, the second copy remains in the licensing authority.

Suspension, cancellation and termination of the validity of the license

Suspension, cancellation or termination of the validity of the license shall be carried out by the licensing authority in cases and in accordance with the procedure provided for in articles 22, 23 and 24 of the law of the Republic of Uzbekistan "On licensing of certain types of activities".

Once gross violation of the terms and conditions of the license, which will be the basis for the termination of the validity of the license in accordance with the established procedure, includes:

providing tourism services without an appropriate contract with clients or foreign partners;

absence in the licensee of a security system for the life, health and property of tourists and excursionists, certified by the certificate of tourism services;

in the provision of tourism services, the absence of an employee with a diploma of higher education, secondary special, vocational education in the direction of "tourism" in the state of the licensee or a valid certificate of qualification issued by the licensee in accordance with the established procedure.

It is possible to appeal to the court on the decision of the licensing authority on suspension, cancellation or termination the validity of the license. In the event that it is recognized by the court that the suspension, cancellation or termination of the validity of the license is unreasonable, the license authority will respond in the amount of damage suffered by the licensee.

The state fee paid will not be returned when the validity of the license is cancelled and terminated.

License register

The licensing authority maintains a register of licenses for tourism activities, which specifies:

a) basic information about licensees – the name of the organization and taxpayer identification number, legal form, information about branches, last name, first name and patronymic of the organization's head;

b) date of issue and license number;

c) the series and number of the form license;

d) direction of tourist activity;

e) the address where the licensed activity will be carried out, contact phone numbers, fax, email address and other contacts;

f) data on the certificate of tourist services and tourist products;

g) grounds and dates of renewal, suspension and renewal of the license;

h) grounds and dates of termination or cancellation of the license;

i) the basis and date of issue of the duplicate.

The information contained in the license registers is published on the official website of the licensing authority and is open for review.
